EU Terms & Conditions of Sale

For private customers resident in the European Union

These terms and selling conditions (hereinafter “terms and conditions”) concern the regulation of the purchase of products in the online distant selling through the website www.gym-stars.com in compliance with Italian and European Union legislation.

This site is owned by Stoccolma 1912 di Davide Cantarutti, with registered office in Via San Daniele, 10, 34071 Cormons ( GO ), and is dedicated to the retail sale of sports equipment and clothing.

The Customer is obliged, before sending the order, to carefully read the terms and conditions that have been made available to them on the website to allow the reproduction and storage of information.

Contracts concluded at a distance with Stoccolma 1912 through the website are governed by these terms and conditions in compliance with Italian law.

1) How to place an order

We only accept orders placed via our website.
Cart mode available on our website: browsing through the product categories you can reach the desired product sheet. It, in addition to providing the description, price, photos, color variations and product availability, provides a button with the words “Add to cart”. It allows you to place your selected item in a separate shopping cart. This cart can be modified by varying the quantities and/or by deleting an item. To complete the operation you must choose “Proceed with the order” and you will be asked to fill in a form with your personal data for both billing and shipping and the desired payment method. For shipping we recommend providing an active phone number for the courier to contact you in case of need and an address where there is always someone to sign for the delivery. All fields marked with the * symbol are mandatory. By accepting the conditions of sale and clicking on “Place the order” you will see the summary of the order just made. Your order will be processed and sent as soon as possible to the shipping address provided.
Some items are not available for immediate purchase. For them it is necessary to request a price quote by filling in all the mandatory fields of the relevant form. You will receive a prompt answer by email.

2) Shipping methods and information

Depending on the size of the package and the value contained within it, the shipment can be made:

TO ITALY by the following couriers:
  • TNT TRACO
  • SDA
  • UPS
  • BRT

Couriers deliver from Monday to Friday and delivery generally varies from 2 to 4 working days. There is delivery only to the ground level.

Transportation costs for Italy are calculated and displayed automatically by the system.

  • Free shipping is available for orders above 92 € on total amount of goods. This does not apply to packages containing hoops of dimensions equal or larger than 70 x70 x 10 cm where the final shipping cost will be given automatically on the website.

The goods will be shipped with the courier that is shown by the system at the time of payment confirmation. In case that courier encounters logistical problems the goods will be delivered by another courier available among those listed above. Pastorelli Sport is not responsible for any delays by the courier in the delivery of the package.

ABROAD by the following couriers:
  • TNT TRACO
  • UPS
  • DHL
  • POSTA SLOVENIJE
  • BRT

Delivery times vary depending on the destination country of the shipment and are displayed at the time of order. There is delivery only to the ground level.

Transportation costs are calculated and displayed automatically by the system.

  • For some EU countries free shipping is available for orders above 100 € of total amount of goods. This is applied to packages containing hoops of dimensions equal or larger than 70 x70 x 10 cm too.
  • For countries outside the EU there is no free shipping. Any assessments by country customs are not included in the amount of transport costs calculated by the system.
  • The goods will be shipped with the courier that is shown by the system at the time of payment confirmation. In case that courier encounters logistical problems the goods will be delivered by another courier available among those listed above. Pastorelli Sport is not responsible for any delays by the courier in the delivery of the package.
3) Payment methods

Payment can be made in the following ways:

  • BANK TRANSFER IN ADVANCE (the order will be sent when the funds are received in the bank account). You have 5 working days to complete the bank transfer before the order is cancelled.
  • PAY PAL IN ADVANCE.
  • CREDIT CARD (paying directly on the website).
4) Returns and refunds

The consumer has the right to withdraw from the contract without penalty and without specifying the reason, within the period of 14 calendar days, starting from the day of receipt of the goods.

The right of withdrawal is exercised, within the deadline, sending an e-mail to stoccolma1912@gmail.com . The only additional charges payable by the consumer for exercising the right of withdrawal are the direct costs of returning the goods to the sender. The goods must arrive in the same state in which they were delivered. If the right of withdrawal has been exercised by the consumer in accordance with the above procedures, the company Stoccolma 1912 will refund the value of the goods.

The consumer may not exercise the right of withdrawal provided above for contracts for the supply of goods made to measure or clearly customized or which, by their nature, cannot be sent back or are likely to deteriorate or change rapidly.

In case of exercise of the right of withdrawal, the Seller will refund to the Customer all payments made for the purchase of the returned products, except for shipping costs. The return will take place through the same means used by the Customer for the initial purchase.

The right of withdrawal does not apply to customized products.

5) Color matching

Although the Seller constantly takes measures to ensure that the photographs shown on the site are faithful reproductions of the products, including the use of technological solutions possible to minimize inaccuracies, some variations are always possible because of the technical characteristics and the resolution of the colors of which the computer is equipped. Consequently, the Seller will not be liable for any inadequacy of the graphic representations of products shown on the site due to the aforementioned technical reasons, since such representations have merely illustrative functions.

6) Size matching

The recommended sizes in the various models refer to standard measures and are only indicative.

The Seller declines all responsibility for the choice of the size requested. However the article can be returned according to the rules of the right of withdrawal listed above.

7) Prices

The prices displayed on the Internet are as follows:

  • for EU countries, including VAT and excluding shipping;
  • for non-EU countries, excluding VAT and shipping.
8) Compliance warranty

According to EU legislation, the seller is liable for defects in conformity (existing at the time of delivery) that occur within two (2) years after the delivery of the goods.
To take advantage of the legal guarantee, the consumer must report the lack of conformity to the seller within (2) two months from the date on which he discovered the defect.
Any defect of the item must be reported through the appropriate form “Returns and refunds”, attaching the photo of the item and a copy of the receipt of payment.
The validity of the warranty is subject to the fact that the item was defective and not worn out for use. All items must be used correctly and the normal rules of use and maintenance must be observed. Defects caused by incorrect handling, use of excessive force, excessive load, dirt and excessive humidity are not covered by warranty.
Failure to use on non-approved FIG carpet will void the warranty from the first day.
Being objects of consumption, the normal aesthetic and physical wear due to the use is inevitable. This is not covered by warranty.
Once the lack of conformity of the purchased product has been established, the Customer will have the right to ask for the goods to be fixed or to ask for a price reduction; the return of the item, without additional charges, is provided if the two previous options are not possible.

9) Applicable law

This contract is governed by Italian Law as well as EU legislation with particular reference to Regulation (EU) no. 1215/2012 and Regulation (EC) no. 593/2008.

10) Protection of confidentiality and processing of Buyer’s data

Stoccolma 1912 protects the privacy of its customers and guarantees that the processing of data is in compliance with the provisions of the Privacy Regulation (EU) 2016/679 and its subsequent amendments.

Personal and fiscal data acquired directly and/or through third parties by Stoccolma 1912, the data controller, are collected and processed in paper, computer and electronically in accordance with the methods of processing for the purpose of registering the order and activating the procedures for the execution of this contract and the related necessary communications, in addition to the fulfilment of any legal obligations, as well as to allow an effective management of business relationships to the extent necessary to better perform the service requested (Art. 24, paragraph 1, lett. b, d.lgs. 196/2003).

Stoccolma 1912 undertakes to treat with confidentiality the data and information transmitted by the Buyer and not to disclose them to unauthorized persons, nor to use them for purposes other than those for which they were collected or to transmit them to third parties. Such data may be disclosed only at the request of the judicial authority or other authorities authorized by law.

Personal data will be communicated, after signing a commitment to confidentiality of the data, only to subjects delegated to the accomplishment of the activities necessary for the execution of the contract stipulated and communicated exclusively for this purpose.

The Buyer enjoys the rights referred to in art. 7 of d.lgs. 196/2003, namely the right to obtain:
a) the updating, rectification or, where relevant, integration of the data;
b) the deletion, transformation into anonymous form or blocking of data processed in violation of the law, including those whose storage is not necessary in relation to the purposes for which the data were collected or subsequently processed;
c) proof that the operations referred to in paragraphs a) and b) have been brought to the attention, including as regards their content, of those to whom the data have been communicated or disseminated, except where such performance proves impossible or involves the use of means manifestly disproportionate to the protected right. The data subject also has the right to object, in whole or in part: i) for legitimate reasons to the processing of personal data concerning him, even if relevant to the purpose of the collection; ii) the processing of personal data concerning him for the purpose of sending advertising material or direct sales or for the performance of market research or commercial communication.

The communication of your personal data by the Buyer is a necessary condition for the correct and timely execution of this contract. In default, the Purchaser’s request cannot be granted.

In any case, the acquired data will be stored for a period of time not exceeding that necessary for the purposes for which they were collected or subsequently processed. Their removal will be secure.

11) Storage of the contract

Pursuant to art. 12 of the d.lgs. 70/2003, Stoccolma 1912 informs the Buyer that every order sent is stored in digital form at the headquarters of Stoccolma 1912 according to confidentiality and security criteria.

Stoccolma 1912 in the distance selling fulfils its obligation pursuant to art.1510, 2nd paragraph of the Civil Code about the delivery of the product sold to the buyer from the moment in which the goods are delivered intact to the courier, only guaranteeing for the defects of the same, not attributable to the transport, which must be identified within the time prescribed by law.
We would like to remind our Customers it is their duty to track the shipment so that they can, at any time, assure in order to avoid deposits and/or return of the goods. Also, we would like to remind our Customers to sign conditionally when the delivery arrives in case the package contains breakages and/ or dents in order to address this directly with the courier. In the presence of damage caused by the courier, Pastorelli Sport s.r.l. is not required either to refund or to replace the goods. Within eight days of receipt the customer may report to Stoccolma 1912 damages and losses not recognizable at the time of delivery. After eight days, no reports can be processed.

3) Payment methods

Payment can be made in the following ways:

The right of withdrawal does NOT apply to purchases of small entity. In order to qualify as a “small entity”, the limit is 50 euros.
For orders over 50 euro the consumer has the right to withdraw from the contract without any penalty and without specifying the reason, within the period of 14 days, starting from the day of receipt of the goods.
The right of withdrawal is exercised within the aforementioned period, using the appropriate form “Returns and refunds”. 8) Compliance warranty

The seller is required to ensure that the sold thing is immune from defects that make it unsuitable for the use to which it is destined or significantly reduce its value. This defect may consist both in a material imperfection of the thing that affects its suitability to be used and in the lack of quality that results in the lack of the requirements of functionality, utility and value that the thing should present.
The buyer can claim only “hidden” defects, in the sense that the buyer, at the time of delivery of the goods not only did not actually know, but could not even detect them using ordinary diligence.
The defects must be significant and only those of sufficient gravity to make the good unsuitable for the use to which it is destined or such as to appreciably reduce its value.
In case of significant defects, the customer will then have a double choice, may ask: 1) price reduction, 2) termination of the contract.
The validity of the guarantee is subject to the fact that the articles have been used correctly and the rules of use and maintenance have been observed.
Defects caused by incorrect handling, use of force, excessive load, dirt, or moisture are not covered by the warranty. Failure to use on non-approved FIG carpet will void the warranty from the first day.
Since they are consumer items, there is no guarantee the normal aesthetic and physical wear and tear due to use.
Once the existence of significant defects has been established, the Customer will have the right to return the item without additional costs or as an alternative to reimbursement of the item and shipping costs.

9) Applicable law

The parties agree that this contract is governed by the rules laid down by the same and by the “Lex Mercatoria”, a system of customary rules that originates from the development of international trade relations, in particular the “unidroit principles of internationale commercial contracts”, which you can read at https://www.unidroit.org/english/principles/contracts/principles2016/principles2016-e.pdf

10) Place of jurisdiction

The parties agree that for any dispute relating to the application, execution, interpretation of this contract entered into online, through the website www.pastorellisport.com , is exclusively competent the Court of Gorizia, Italy.

11) Protection of confidentiality and processing of Buyer’s data

Stoccolma 1912 protects the privacy of its customers and guarantees that the processing of data is in compliance with the provisions of the privacy law referred to in d.lgs. (Italian) 30 June 2003, n. 1961.

12) Storage of the contract

Stoccolma 1912 informs the Buyer that every order sent is stored in digital form at the headquarters of Pastorelli Srl according to strict criteria of confidentiality and security in use in the company.

13) Tax aspects

Sales from Italy to EXTRA EU with customer taxed and with transport by and name of the buyer.
The transaction is defined as export, non-taxable VAT pursuant to art. 8 c/1 lit. b) Dpr 633/72, but it is necessary that: a) the goods are exported without processing in Italy; b) the goods leave national borders within 90 days with proof to be acquired by the seller within 30 days.

Sales from Italy to EXTRA EU with private customer and with transport by and name of the seller.
The transaction is defined as export, non-taxable VAT pursuant to art. 8 c/1 lit. a) Dpr 633/72; in this case the seller should be able to provide a copy of the invoice or other customs documentation from where the export of the goods takes place. Mail shipments are also treated as such and specific proof of export is required.

Sales from Italy to EXTRA EU with private customer and with transport by and name of the buyer.
In this case the transaction is taxable VAT, unless the buyer operates as a tourist/ traveller; in fact, pursuant to art. 38 quater Dpr 633/72, it is possible to sell goods (so-called well-defined goods) for personal/family use (provided the amount exceeds 155 euros), not subjecting them to VAT; in this case the goods must leave the national borders within the third month following the sale; In addition, a copy of the invoice must be returned to the seller with the details of the passport and customs visa; alternatively, there are private companies that are responsible for reimbursing the VAT to the tourist simplifying the procedures.
